1. Acceptance of Terms

By accessing or using Brikl ("the Service") — including the Brikl WhatsApp assistant, website, or any related services operated by Brikl Technologies Ltd — you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use the Service.

These terms apply to all users, including Free and Pro plan subscribers.

2. Description of Service

Brikl is an AI-powered business assistant delivered via WhatsApp. The Service enables small business owners and vendors to:

• Generate professional quotes for their clients
• Log and track payments using receipt screenshots
• Query their business records in plain English
• Receive monthly bookkeeping reports (Pro plan)
• Receive funding eligibility alerts (Pro plan)

Brikl operates within WhatsApp using the WhatsApp Business Platform. We are not affiliated with Meta or WhatsApp Inc.

3. Eligibility

You must be at least 18 years of age to use the Service. By using Brikl, you confirm that you are 18 or older and have the legal capacity to enter into a binding agreement.

The Service is currently designed for businesses operating in Nigeria. Use outside Nigeria is permitted but support and compliance is optimised for Nigerian regulations.

4. Account Setup

To use Brikl, you must provide your business name, the type of goods or services you sell, and your bank account details for the Account Details Card feature. You are responsible for the accuracy of all information provided.

You are responsible for maintaining the confidentiality of your WhatsApp account, which serves as your access credential to Brikl.

5. Free Plan

The Free plan is provided at no cost and includes: unlimited quote generation, payment logging, account details card, and basic business queries. We reserve the right to modify the Free plan features at any time with reasonable notice.

6. Pro Plan and Billing

The Pro plan is billed at ₦2,500 per month. Payment is collected via WhatsApp payment link or bank transfer on the 1st of each month. Failure to pay within 3 days of the due date may result in downgrade to the Free plan.

Refunds are available within 3 days of each monthly billing date if requested. After 3 days, the current month's payment is non-refundable.

We reserve the right to change Pro plan pricing with 30 days notice delivered via your Brikl WhatsApp chat.

7. Acceptable Use

You agree not to use Brikl for any unlawful purpose or in any way that could damage, disable, or impair the Service. You must not:

• Use the Service to process fraudulent transactions or false records
• Attempt to reverse-engineer, scrape, or copy any part of the Service
• Use Brikl to generate quotes for illegal goods or services
• Share your Brikl access with third parties for commercial resale
• Submit false or manipulated receipt screenshots to inflate records

Violation of acceptable use may result in immediate suspension without refund.

8. Data and Privacy

Your use of Brikl is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of your business data as described therein.

Your business data — quotes, payments, client records — belongs to you. We do not sell your data to third parties.

9. Accuracy of Reports

Brikl Pro reports are generated from the data you provide via WhatsApp. The accuracy of your reports depends on the completeness of the data you log. Brikl Technologies Ltd is not responsible for decisions made by financial institutions, funders, or lenders based on Brikl-generated reports. Reports are provided for your reference and convenience and do not constitute certified financial statements.

10. Funding Alerts Disclaimer

Funding eligibility alerts are based on publicly available information about Nigerian funding programmes (TEF, BOI, NIRSAL, CBN MSME Fund, LAPO, AB Microfinance and others). Brikl does not guarantee that you will qualify for or receive any funding. Eligibility assessments are informational only. We encourage you to confirm requirements directly with each programme.

11. Intellectual Property

All content, branding, software, and features of the Brikl Service are the intellectual property of Brikl Technologies Ltd. You may not reproduce, distribute, or create derivative works without written permission.

12. Limitation of Liability

To the maximum extent permitted by law, Brikl Technologies Ltd shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to: lost business, financial loss based on report data, or failed loan applications.

Our total liability in any matter related to the Service shall not exceed the amount you paid to us in the 3 months prior to the claim.

13. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms. Upon termination, your data is retained for 90 days and then deleted permanently unless a legal hold applies.

14. Changes to Terms

We may update these Terms at any time. Material changes will be communicated via your Brikl WhatsApp chat at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the new terms.

15. Governing Law

These Terms are governed by the laws of the Federal Republic of Nigeria. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of Nigerian courts.
